New Jersey is following suit with legalizing marijuana as recreational based on the state’s democratic seat leader who wants to start a discussion about the legalization.
Possession:
50 grams or less
- Disorderly Person
- 6 months incarceration
- $1,000 fine
More than 50 grams
- Misdemeanor/Possibly a Felony
- 1 and a half years incarceration
- $25,000 fine
Selling/Distribution:
Less than 1 oz to 25 pounds or more
- Felony
- 1.5 – 20 years incarceration
- $25,000 – $300,00 fine
Within 1000 feet of a school or school bus
- Felony
- 3-5 years incarceration
- $150,000 fine
To minors or pregnant women carries a double term of imprisonment and fine.
Growing/Cultivation:
1 oz – less than 5 lbs (less than 10 plants)
- Felony
- 3-5 years incarceration
- $25,000 fine
More than 25 lbs (50 plants or more)
- Felony
- 10 – 20 years incarceration
- $300,000 fine

Qualifying Conditions
- Amyotrophic Lateral Sclerosis (ALS)
- Cancer (includes associated chronic pain and/or severe nausea)
- Crohn’s disease
- Glaucoma
- HIV/AIDS (includes associated chronic pain and/or severe nausea)
- Inflammatory bowel disease (IBD)
- Multiple Sclerosis
- Muscular Dystrophy
- Post-Traumatic Stress Disorder
- Seizure and/or spasticity disorders
- Any terminal illness if a doctor has determined the patient will die within a year
Patient Limits:
Two ounces per month
