Oregon has taken the first approach to actual recreational public legal cannabis.

Possession:

Public Use

1 oz or less

  • No penalty, completely legal

More than 1 – 2 oz

  • Violation
  • $650 fine

More than 2 – 4 oz or more

  • Misdemeanor
  • 6 Months – 1-year Incarceration
  • $2,500 – $6,250 fine

Home Use

8 oz or less homegrown

  • No Penalty, completely legal

More than 1 – 2 lbs or more

  • Misdemeanor
  • 6 Months – 1-Year Incarceration
  • $2,500 – $6,250 fine

Distribution/Delivery:

1 oz or less homegrown without compensation

  • No penalty, completely legal

More than 1 oz – 16 oz without compensation

  • Violation
  • $2,000 fine

16 oz or more with compensation

  • Misdemeanor
  • 1-Year Incarceration
  • $6,250 fine

To a minor

  • Felony
  • 5 years Incarceration
  • $125,000 fine

Within 1000 feet of school grounds

  • Felony
  • 20 Years Incarceration
  • $375,000 fine

Growing/Cultivation:

16 oz or less solid infused at home

72 oz or less liquid infused at home

1 oz or less extract at home

  • All three above are legal

0.25 oz or less not purchased from retailer

  • Misdemeanor
  • 6 Months Incarceration
  • $2,5000 fine

More than 0.25 oz

  • Felony
  • 5 years Incarceration
  • $125,000 fine

Medical Marijuana:

Qualifying Conditions

  • Alzheimer’s disease
  • Cachexia
  • Cancer
  • Chronic pain
  • Glaucoma
  • HIV or AIDS
  • Nausea
  • Persistent muscle spasms
  • Post-traumatic stress
  • Seizures
  • Other conditions are subject to approval

Patient Limits

Twenty-four ounces of usable cannabis

Currently Pending:

Oregon passed a series of laws concerning medical cannabis, industrial hemp, and adult pot use. Now that the Joint Committee has dissolved, you can expect to see fewer bills on cannabis going forward: most of the work to shape legislation and public policy is done in committee.
